Terms of Service

1. About Worktrak Recruit

Worktrak Recruit is a cloud-based Applicant Tracking System (ATS) provided by Worktrak ("we", "us", "our"). The service is accessible at recruit.worktrak.in and is designed to help businesses manage their recruitment workflows.

2. Acceptance of Terms

By registering for, accessing, or using Worktrak Recruit, you ("Customer", "you") confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using the service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

We reserve the right to update these terms at any time. We will notify users of material changes via email or an in-app notice. Continued use of the service after such notice constitutes acceptance of the updated terms.

3. Your Account

To use Worktrak Recruit, you must request a workspace through our signup process. Upon approval, an administrator account is created for your organisation. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Ensuring all users added to your workspace comply with these terms.
• Promptly notifying us of any unauthorised access at support@worktrak.in.

We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are involved in fraudulent or unlawful activity.

4. Subscription Plans and Payment

Worktrak Recruit offers a Free plan and paid subscription plans (Standard and Enterprise). Paid plans are billed annually and are payable upfront. Prices are as stated on our Pricing page at the time of subscription.

• Free Plan: Available indefinitely at no cost, subject to capacity limits stated on the Pricing page.
• Paid Plans: Subscriptions run for 12 months from the activation date. No refunds are issued for unused portions of a subscription period except where required by applicable law.
• Taxes: Prices are exclusive of applicable taxes. Indian customers will be charged 18% GST in addition to the listed price.
• Changes to Pricing: We reserve the right to change subscription pricing with 30 days' notice. Changes will not affect an active subscription period.

5. Acceptable Use

You agree not to use Worktrak Recruit to:

• Process or store data in violation of applicable laws, including data protection laws.
• Upload or transmit malicious code, viruses, or any harmful software.
• Attempt to gain unauthorised access to any part of the service or other tenants' data.
• Use the service for any purpose other than legitimate recruitment and hiring workflows.
• Reverse-engineer, decompile, or attempt to derive the source code of the service.
• Resell, sublicense, or otherwise commercialise access to the service without our written consent.

6. Data Ownership and Candidate Data

You retain full ownership of all data you upload to Worktrak Recruit, including candidate information, job descriptions, and documents ("Customer Data"). We do not claim any rights over your Customer Data.

You are responsible for obtaining any necessary consents from candidates before storing their personal information in the system, and for complying with applicable data protection legislation (including India's Digital Personal Data Protection Act, 2023).

We will not access your Customer Data except as necessary to provide the service, respond to support requests, or as required by law.

7. Service Availability and SLA

We aim to maintain high availability of the service but do not guarantee uninterrupted access. The service is provided "as is" and "as available". We reserve the right to perform maintenance, which may result in brief periods of unavailability.

We will make reasonable efforts to notify customers of planned maintenance windows in advance.

8. Intellectual Property

The Worktrak Recruit software, interface, branding, and all associated intellectual property remain the exclusive property of Worktrak. Nothing in these terms grants you any rights to use our trademarks, logos, or intellectual property other than as necessary to use the service.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Worktrak shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability to you for any claim arising under these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may terminate your account at any time by contacting us at support@worktrak.in. We may suspend or terminate your account immediately if you breach these terms. Upon termination, your right to use the service ceases and we may delete your data in accordance with our data retention policy described in our Privacy Policy.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.
